Italy’s ChatGPT Ban

ChatGPT and other artificial intelligence programs continue to dominate the conversation on the tech scene, and wonder and excitement for the technology are just as fruitful topics as the controversy. On an individual and discipline level, discussion has centered around the ethics of automatically generated content. There is another level of controversy that has been reached, though: the murky waters of international regulations.

Just as artists have concerns over the potential threat to their work and livelihood, some governments have voiced concerns over the threat to safety and privacy ChatGPT and other AI programs pose. There have been long discussions about the limited regulation the AI sphere has encountered, and it seems that governments like Italy’s have stepped in as the most recent players in regulatory practices.



Security and Privacy Concerns

Italy’s concerns are not necessarily unique, but they are notable since they resulted in the first official national ban on ChatGPT. Most urgent was an Italian regulation entity’s concern over data security, especially after an Open AI data breach that has been recognized by the AI startup itself. Security breaches are nothing new and are certainly not specific to Open AI, but many European countries and other countries around the world take these security vulnerabilities very seriously.

Beyond the limited payment and personal info that was exposed during the breach, and potentially less limited info that could be exposed in the future. A data breach into ChatGPT servers can reveal what kinds of conversations users were having with the bot. The conversational and friendly nature of the bot grants users some confidence in the intimacy and privacy of the chat but, of course, users are chatting with an algorithm that has no real commitment to privacy. Maybe you’ve chatted with ChatGPT yourself, and maybe you’ve had some conversations that would look fishy taken out of context. In a data breach, you have no control over who sees your conversations, and very little control over the resulting narrative.



Moderation and Regulation Concerns

Another big concern raised by the Italian regulator was about the lack of moderation and regulation exercised by Open AI. One now rather well-known issue haunting ChatGPT enthusiasts is that current iterations of the application are meant to be more of a proof-of-concept rather than a fully dependable AI assistant, despite its widespread adoption in professional niches. Open AI recognizes that caution needs to be exercised when chatting with the program, since ChatGPT responses often contain inaccuracies for a myriad of reasons—something that GPT4 is promised to improve significantly.

Despite the controversy behind these inaccuracies and other similar limitations, many users remain unaware and trust the program’s responses rather uncritically, which has resulted in at least one legal controversy. Open AI has done little to make these caveats well known, which the Italian government has argued to be irresponsible and unethical. They claim that children specifically are especially susceptible to believing and reproducing inaccuracies in the responses. Since the app is readily available to any user of any age group, there are few safety nets in place to protect children from the inevitable misinformation.



ChatGPT’s Return to Italy

ChatGPT was indeed banned in Italy for the previous reasons. However, after Open AI addressed some concerns and committed to implementing the appropriate safety measures, the software was welcomed back into the country. This does not leave Open AI off the hook, though.

Italy continues to have concerns over the safety of this and similar AI programs, and other countries have followed suit. Many western countries are cautious about the same security and safety concerns raised above, and ChatGPT is inaccessible in some other parts of the world altogether. Additionally, although Open AI addressed the raised concerns enough to be welcomed back in Italy, some concerns were only addressed lightly, or may have been ignored altogether. Logging into ChatGPT requires an email account but, beyond that, there are no filters or restrictions. It seems that there have been little efforts, if any, to limit children’s access to the platform, and the website offers little-to-no warning about the experimental and inaccurate nature of the generated responses. Security patches are good and appreciated, but Open AI still has some work cut out for them if they want to steer clear of further controversies and regulatory concerns.
